Flux Clinical Nutrition Terms & Conditions of Use
These Terms and Conditions govern your use of the Flux Clinical Nutrition website at https://www.fluxnutrition.com.au and the booking of Telehealth nutrition consultations with Flux Clinical Nutrition, operated by Candice Stevens. By using the website or booking an appointment, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must stop using the website and Services immediately.
Flux Clinical Nutrition reserves the right to update these Terms at any time by updating this page. Material changes take effect immediately upon publication.
1. About the Website & Services
The website provides Telehealth consultations, nutritional guidance, educational resources, blogs, and related services (the "Services"). All consultations are conducted online via Telehealth.
Access to and use of the website or any of its Services is governed by these Terms.
2. Acceptance of These Terms
You accept these Terms by using the website or Services, or by clicking "I Agree" or a similar prompt on the website.
You may not use the Services if:
You are not of legal age to form a binding contract; or
You are barred from receiving services under Australian law or the law of your country of residence.
3. Account Registration & Subscriptions
To access certain Services, you may be required to purchase a subscription or package ("Subscription") and pay the applicable fee ("Subscription Fee").
Registration may be required to access Services. As part of registration, you may be asked to provide:
Name and email address
Phone number
A password to secure your account
You warrant that all information provided during registration is accurate and up-to-date, and you agree to keep your login credentials confidential and notify us immediately of any unauthorised use of your account.
Your access to Services continues until your Subscription expires ("Subscription Period"). Flux Clinical Nutrition may vary Subscription Fees at any time; changes take effect after the current Subscription Period.
4. Appointment Bookings & Payments Bookings
Payment is required at the time of booking unless otherwise arranged in writing. You are responsible for ensuring your contact details are accurate so that session links and reminders are received.
Payment Methods
Payments may be made via approved methods, including credit card and direct debit. You are responsible for any fees or charges associated with failed or declined payments. All payments are subject to the terms of the relevant payment provider.
Cancellation & Rescheduling
To provide fair access to appointments and to respect the time of all clients, the following policy applies:
More than 24 hours' notice:
You may cancel or reschedule at no charge.
Less than 24 hours' notice:
A 50% late-cancellation fee applies.
No-show (no notice):
The full consultation fee will be charged.
If you are more than 10 minutes late, the session may be shortened and will still be charged in full.
Fees may be waived in cases of genuine emergency or unforeseen circumstances at the sole discretion of Flux Clinical Nutrition.
Refunds
Consultation fees are non-refundable once a session has been completed. Refunds for prepaid services will only be provided if Flux Clinical Nutrition is unable to deliver the service. Refunds are not available for change of mind.
Where Flux Clinical Nutrition determines a refund is appropriate, it will be proportional to the unused portion of the Subscription or prepaid package.
5. Telehealth Consultations
Your responsibilities
To ensure a high-quality Telehealth experience, you agree to:
Attend each session in a private, quiet space free from distractions.
Ensure you have a stable internet connection and a compatible device.
Not participate in a session while driving or performing any activity that may compromise safety or privacy.
Notify the practitioner immediately if technical issues arise on your end.
Provide honest, thorough, and accurate information - nutrition advice is based on what you disclose.
Inform your practitioner of any changes to your health, medications, or relevant medical history.
If you are unable to connect within 10 minutes of the scheduled start time, we will attempt to contact you. If contact cannot be made, the session may be forfeited and the late-cancellation fee will apply.
Our responsibilities
Flux Clinical Nutrition will:
• Provide a secure, private Telehealth session.
• Communicate clearly about any technical delays or issues.
• Deliver evidence-based, client-centred nutrition advice.
6. Client Responsibilities
By engaging our Services, you agree to:
• Use the Services only for lawful purposes and in compliance with these Terms.
• Refrain from using the website or Services for commercial purposes unless approved in writing by Flux Clinical Nutrition.
• Avoid illegal or unauthorised activity, including spamming or unauthorised linking. Automated use of the website or Services is prohibited.
7. Scope of Services & Clinical Limits
Services are intended for general nutrition support and education. They do not replace medical advice, diagnosis, or treatment by a qualified medical practitioner.
Our Services are not appropriate for emergency or crisis care. If you have an urgent health concern, please contact your GP or call emergency services (000) immediately.
Flux Clinical Nutrition reserves the right to end a professional relationship where the arrangement is no longer clinically appropriate, where safety cannot be maintained, or where these Terms have been breached. Where practicable, reasonable notice and referral assistance will be provided.
8. Confidentiality & Privacy
All personal information is collected, used, and stored in accordance with the Flux Clinical Nutrition Privacy Policy, available on our website.
Telehealth sessions are not recorded by Flux Clinical Nutrition. You agree not to record any session without obtaining our explicit prior written consent.
9. Intellectual Property
The website, Services, and all related content - including text, graphics, logos, videos, and designs - are protected by copyright and are owned by Flux Clinical Nutrition or its licensors.
You are granted a limited, non-exclusive, revocable licence to use website content for personal, non-commercial purposes only. You may not reproduce, distribute, adapt, or publicly display any website content without our prior written permission.
10. General Disclaimer
Nothing in these Terms limits or excludes any guarantees, warranties, or rights implied by law that cannot lawfully be excluded (including under the Australian Consumer Law).

You may terminate by not renewing your Subscription, providing written notice of termination, or closing your account.
We may terminate or suspend your access if you breach these Terms, if we are required to do so by law, or if providing the Services is no longer commercially viable.
14. Dispute Resolution
If a dispute arises, both parties must first attempt to resolve it in good faith through negotiation or mediation in Melbourne, Australia. Mediation costs will be shared equally unless otherwise agreed.
If the dispute is not resolved within 14 days of written notice, either party may seek legal recourse.
15. Governing Law & Jurisdiction
These Terms are governed by the laws of Victoria, Australia. Any disputes will be resolved exclusively in the courts of Victoria, Australia.
16. Severance
If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed and the remainder of the Terms will continue in full force and effect.
17. Agreement
By using the website or booking an appointment, you confirm that you have read and understood these Terms and Conditions and agree to the policies regarding bookings, cancellations, refunds, online conduct, confidentiality, privacy, and scope of care.
